Basically, you can buy Ne'er Misser from a merchant in Roah Moonglow in Moonrise Towers, at the following coordinates X: -175, Y: -175. That is, you can get it in Act 2 only. After you find him, you should check for Ne'er Misser. If it is not available, then most likely your level is not yet high enough to buy it.
Coordinates: X: 275, Y: -10
It is worth noting that if you want to get this crossbow, you shouldn’t kill Roah Moonglow since this is the only way to get it. Also, if you do not find this merchant at the above location, you should look in Shattered Sanctum at coordinates X: 275, Y: -10 and check there.
